Kohberger Faces Monumental Legal Hurdles, Says DC Sniper Defender

Bryan Kohberger, who pleaded guilty in July 2025 to the murders of four University of Idaho students, now seeks to have that plea withdrawn.

The guilty plea resulted in four consecutive life sentences without the possibility of parole, a deal that spared him from a potential death penalty.

Mark Petrovich, a veteran criminal defense attorney, describes the effort to retract a plea after sentencing as a “monumental uphill battle.”

Petrovich notes that a judge must first allow the withdrawal, and even then the defendant faces a daunting challenge of securing a favorable outcome in a new proceeding.

Cooper’s defense claims he was pressured into the plea, did not fully grasp exculpatory evidence, and was misled about incarceration conditions, questioning the voluntariness of his admission.

Unlike cases where a plea is withdrawn before sentencing, Kohberger has already been sentenced, limiting his ability to change his position after the fact.

Should a judge grant the request, jurors would still be aware of his prior guilty admission, presenting a significant hurdle in any subsequent trial.

Petrovich also raises doubts about whether Kohberger’s counsel thoroughly reviewed all discovery material before recommending the plea, noting that capital case attorneys typically spend years examining evidence.

Historical precedents show that attempts to retract guilty pleas often fail, with other defendants in similar situations ultimately denied the opportunity for a new trial.

The plea agreement, which concluded years of litigation, made a capital trial unnecessary; however, its withdrawal would be exceptionally difficult given the extensive discovery and negotiation that preceded it.
