A federal judge has dealt a significant blow to Hood County officials in a high-profile lawsuit brought by Navy veteran and conservative commentator Kolton Krottinger. Krottinger was arrested in November 2025 after being accused of online impersonation over a satirical political meme posted to the Hood County Sheepdogs Facebook page.
The page was openly described as satire, and Krottinger maintained that the meme was protected political speech. His alleged crime was a photoshopped image that made it appear as if Tina Brown was endorsing Monica Brown for school board. In reality, Tina supported the rival candidate.
A judge has now ruled that Krottinger's constitutional claims deserve to proceed, dealing a significant blow to the defendants. In a detailed 19-page order, the court denied the defendants' Motion to Dismiss across the board. The court also refused to grant qualified immunity to the defendants, finding that Krottinger plausibly alleged clear violations of clearly established constitutional rights.
The court found that no probable cause existed for the arrest, as the satirical post lacked any intent to defraud required by the statute. The court also ruled that the post was protected political satire under the First Amendment, and arresting someone for it is unconstitutional.
The court also found that retaliation claims against both the investigator and the sheriff survive, citing selective targeting of a vocal critic of the Sheriff and omissions in the warrant affidavit. The court also ruled that unlawful phone seizure without a warrant – and continued retention even after charges were dropped – violates the Fourth Amendment.
The court further found that the Sheriff's Office Facebook page functioned as a public forum, and selectively restricting Krottinger's comments while allowing others is viewpoint discrimination. The court also held Monell liability for Hood County, finding that the sheriff is a final policymaker and his actions stick to the county.
