The House Oversight Committee Task Force on Defending Constitutional Rights and Exposing Constitutional Abuses held a hearing on Wednesday to examine the American Bar Association's (ABA) role in law school accreditation.
At the center of the hearing was a tense exchange between Rep. Brandon Gill, R-Texas, and ABA President Michelle A. Behnke over the ABA's diversity principles and their potential impact on the Supreme Court.
Gill repeatedly pressed Behnke on whether the ABA's diversity principles would justify rejecting a third Black Supreme Court justice, suggesting that the organization's policies promote unlawful discrimination.
The ABA has used its accreditation authority to advance race-conscious DEI policies throughout the legal profession, according to Republicans, who argue that the organization has overstepped its bounds.
Behnke defended the ABA's commitment to diversity, stating that it strengthens the profession without supporting racial quotas, and emphasized that the organization does not support discrimination of any sort.
Gill questioned Behnke about the ABA's position on judicial diversity, citing the organization's statement that judges should reflect the diversity of American society, and asked whether a racially representative Supreme Court would be beneficial.
Behnke replied that the ABA believes diversity in all its forms is important, but repeatedly declined to give Gill a yes-or-no answer.
The ABA holds significant sway over legal education, as graduating from an ABA-approved law school is often the primary way to qualify for the bar exam.
Several states, including Texas, Florida, Alabama, and Tennessee, have explored alternatives to relying exclusively on ABA accreditation for bar eligibility, raising questions about the organization's influence over the legal profession.
