The disputed policy stemmed from concerns over the Global Disinformation Index, an organization that received federal funding and produced ratings that some conservatives claim led advertisers to withdraw support from certain news outlets. Critics argued that the ratings contributed to a chilling effect on conservative media.
Under the paused policy, visa access would have been restricted for individuals associated with the Global Disinformation Index and similar groups. The measure sought to penalize those perceived as complicit in foreign censorship efforts.
A State Department spokesperson emphasized that a visa is a privilege, not a right, and that questions about the lawsuit should be directed to the Department of Justice. The department defended its authority to set visa eligibility criteria.
Boasberg has a record of intervening in high‑profile cases involving the administration, including a temporary block on rapid deportations of Venezuelan migrants and an order to preserve communications about planned military strikes. His rulings often focus on preserving procedural safeguards.
The judge’s decisions have drawn criticism from former President Trump, who called for his impeachment, and led to a misconduct complaint filed by the Justice Department. The complaint alleges judicial overreach in the visa case.

The lawsuit was brought by the Coalition for Independent Technology Research, a nonprofit representing academics and journalists, challenging the State Department’s visa policy. The coalition argues that the policy infringes on academic freedom and free expression.
Boasberg’s stay is temporary; he has not yet ruled on the merits, and the State Department retains the option to appeal the injunction. Future court decisions will determine the policy’s ultimate viability.
