The controversy surrounding Special Counsel Jack Smith has taken a new turn, with his attorneys releasing a letter denying allegations of wrongdoing. The letter comes after Smith faced mounting scrutiny from Republicans over his investigation methods.
According to the letter, Smith's team was within its rights when obtaining text messages from lawmakers during its investigation. Smith's attorneys argue that the review of text messages did not involve an intrusion by the Executive Branch into the legislative sphere, as the messages were voluntarily sent by members of the Legislative Branch to members of the Executive Branch.
Smith's team was accused of violating constitutional privacy protections by reading the text messages of 44 members of Congress from both parties and White House staff. However, Smith's attorneys claim that the review of text messages was necessary in order to investigate an Executive Branch official, and that the speech and debate clause does not prevent prosecutors from using or reviewing text messages in such cases.
The referral letter also disputes the notion that Smith's answers to congressional investigators were not truthful. Smith's attorneys argue that he provided truthful, responsive answers and candidly discussed his work as Special Counsel. They also claim that the referral reflects a "chilling eagerness to weaponize the justice system by attacking a career, nonpartisan public servant who faithfully and fearlessly performed his duties by following the facts and the law."
